Vacation and Leave Policies

Understand the regulations on vacation and other types of leave in Indonesia

Holiday leave

In Indonesia, after completing 12 consecutive months of employment, employees are entitled to a minimum of 12 working days of annual leave per year as per Manpower Law No. 13/2003. It's a requirement for employees to take at least 6 consecutive days of leave within a year. Any annual leave that remains unused expires 6 months after the leave accrual period.

Long Service Leave

When employees have worked for the same employer for 6 consecutive years, they are entitled to a long service leave of 1 month in their 7th and 8th year of employment. This is in addition to their regular 12 days annual leave.

Sick Leave

Upon providing a doctor's certificate verifying their illness, employees in Indonesia are entitled to paid sick leave. The compensation for sick leave is as follows:

  • First four months of illness: 100% of regular wages
  • Next four months: 75% of regular wages
  • Third four months: 50% of regular wages
  • Subsequent months: 25% of regular wages until termination of employment.

Maternity Leave

Female employees are entitled to 3 months of paid maternity leave. This period includes 1.5 months before the expected birth date and 1.5 months after.

Paternity Leave

Following the birth of their child, fathers are entitled to 2 days of paid paternity leave.

Important Considerations

More generous leave benefits than the statutory minimums may be provided by employers. For more specific details, refer to your company's policy or collective bargaining agreement. The manner in which leave accrues may vary between companies. Some may accrue leave on a monthly basis, while others may grant the full entitlement after the 12-month qualifying period.

Public holidays

Indonesia observes a mix of national, religious, and cultural holidays throughout the year.

National Holidays

  • New Year's Day (January 1st): Celebrates the start of the Gregorian calendar year.
  • Independence Day (August 17th): Commemorates Indonesia's proclamation of independence from the Netherlands in 1945.
  • Pancasila Day (June 1st): Commemorates the birth of Pancasila, the official philosophical foundation of the Indonesian state.

Religious Holidays

Indonesia is a religiously diverse country, and its public holidays reflect this diversity. The dates of some religious holidays are based on lunar calendars and may vary slightly from year to year.

  • Islamic Holidays:

    • Isra Mi'raj: Commemorates the Prophet Muhammad's nighttime journey and ascension.
    • Eid al-Fitr (Idul Fitri): Marks the end of Ramadan, the holy month of fasting. Celebrations typically last 2-3 days.
    • Eid al-Adha (Idul Adha): The "Festival of Sacrifice," commemorating Abraham's willingness to sacrifice his son.
    • Islamic New Year (Muharram): Marks the beginning of the Islamic calendar.
    • Prophet Muhammad's Birthday (Mawlid al-Nabi): Celebrates the birth of the Prophet Muhammad.
  • Christian Holidays:

    • Good Friday: Commemorates the crucifixion of Jesus Christ.
    • Easter Sunday: Celebrates the resurrection of Jesus Christ.
    • Ascension Day of Jesus Christ: Commemorates the bodily ascension of Jesus Christ into heaven.
    • Christmas Day: Celebrates the birth of Jesus Christ.
  • Hindu Holidays:

    • Nyepi (Day of Silence): Balinese Hindu New Year, a day of silence, introspection, and fasting.
    • Galungan and Kuningan: Balinese Hindu holidays celebrating the victory of good (Dharma) over evil (Adharma).
  • Buddhist Holiday:

    • Vesak Day (Waisak): Commemorates the birth, enlightenment, and death of Gautama Buddha.
  • Chinese New Year: Celebrated by the Indonesian Chinese community.

Additional Holidays

  • Joint Holidays (Cuti Bersama): The Indonesian government may declare additional "joint holidays" to bridge public holidays with weekends, creating longer breaks.
  • Regional Holidays: Some provinces or regions may observe additional public holidays specific to their local traditions and cultures.

Types of leave

Employees are entitled to various types of leave after completing a certain period of continuous service.

Annual Leave

Employees are entitled to a minimum of 12 working days of annual leave after completing 12 months of continuous service. Leave may be accrued on a monthly basis or granted in full after the qualifying period. Employees must use at least 6 consecutive days of leave within a year. Unused leave generally expires after a designated period.

Sick Leave

Employees are entitled to paid sick leave upon verification by a doctor's certificate. Compensation during sick leave is as follows:

  • First 4 months: 100% of wages
  • Next 4 months: 75% of wages
  • Third 4 months: 50% of wages

  • Marriage Leave: Employees are typically granted 3 days of paid leave for their own marriage.
  • Bereavement Leave: Employees may be entitled to bereavement leave in the event of the death of immediate family members.
  • Menstrual Leave: Female employees may be entitled to up to 2 days of menstrual leave per month.
  • Other Special Leave: Leave may be available for reasons like pilgrimage, natural disaster, or fulfilling civic duties.
